Acquittal in Narcotics Case

In this case, while the prosecution could establish safe custody for the smaller parcel of the charas sample that was tested by the Punjab Forensic Science Agency, it failed to prove safe custody for the remaining larger portion of the narcotics seized. No witness from the police storage facility ("the Malkhana") was produced to confirm possession or security of the remaining evidence. This gap was significant.

The Lahore High Court took this gap seriously. Without an unbroken chain of custody, the court held that the recovery of narcotics could not be fully trusted as credible evidence for the larger quantity. The law is clear that in narcotics cases, where recovery itself constitutes the offence, every link in the chain must be confirmed beyond doubt.

Consequently, the court modified the conviction. It upheld the conviction only for the charas sample clearly sent for laboratory analysis, which was about 71.40 grams. The sentence was reduced substantially to one year of rigorous imprisonment and a monetary fine, along with legal benefits provided under criminal procedure laws. The portion of the case relating to the unaccounted parcel of remaining narcotics was dismissed.
